1. Learned counsel for the appellant had informed the Court yesterday that the appellant has died. Learned State counsel was directed to seek instructions in the matter.
2. Mr. Satish Gupta, learned Govt. Advocate, has placed before this Court the information sent by the Station House Officer, Police Station Civil Lines, Bilaspur, mentioning that the appellant has died on 21-32016. Although death certificate has not been annexed, but statement of son of the appellant and the information sent by the Physician to the Registrar (Births and Deaths) has been annexed.
3. Learned counsel for the appellant would submit that legal heirs of the appellant are not interested in prosecuting this appeal any further.
4. In view of the above, the criminal appeal abates and is accordingly, dismissed as abated.
