1. At the outset, learned counsel for the appellant submits that the sole appellant has expired, which has been confirmed by the State Counsel also.

2. The Special/Additional Sessions Judge, Durg vide memo dated 21.10.09 also intimated about the death of appellant. Death certificate of appellant has also been annexed with the communication.

3. In view of the death of appellant and the fact that the legal representatives of deceased appellant have not filed any application for leave to continue the appeal within the statutory period, this appeal stands abated. Sd/- (Pritinker Diwaker) Judge roshan/-
