On due consideration, delay of 357 days in filing the CRMP is condoned. Accordingly, IA No.1/2014 is allowed. 2.
The Trial Court has acquitted the accused of the charges under Sections 364, 376 and 302 of IPC.

Considering the statements of PW-1 Hemant Kumar Sahu, PW-5 Mahendra Kumar Sahu, PW-6 Piteshwar Kumar Sen, PW-7 Rambhagat Sahu and PW-10 Jhagruram Sahu, we are inclined to allow the prayer for grant of leave to appeal. 4.
Accordingly, the CRMP is allowed.

Let regular acquittal appeal be registered and the same be posted for consideration in the week after next.
