The default pointed out by the registry as of now stands ignored for the moment.

The grievance of the petitioner in the instant Writ Petition is that, he is being denied promotion from the post of Sub-Inspector to Inspector only "

on account of punishment which was inflicted upon him more than 5 years back in the year 2013.

According to the counsel for the petitioner, the rigour of that punishment has already been over and there is no further hurdle for the department to consider the case of the petitioner for promotion and the people identically placed have already been promoted in the cadre and the petitioner also was in the zone of consideration, but because of the punishment, he has not been promoted.

Let the petitioner make a fresh representation to the respondents No. 2 & 3 in this regard who in turn shall consider the case of the petitioner in accordance with the rules and regulations pertaining to the promotion and take a decision on the representation to be made by the petitioner, at the earliest preferably within a period of 90 days from the date of receipt of representation.

Needless to mention that, if the authorities find that the petitioner is entitled for promotion, then an appropriate order shall be passed in accordance with the rules granting him the relief of promotion. 6.
