Hon'ble Justice Shri Gautam Chourdiya Order on Board 22/06/2021 1) The matter is heard through Video Conferencing. 2) The petitioner has filed the instant CRMP under Section 439(2) of the Code of Criminal Procedure, 1973 for setting aside the order dated 13/05/2015 passed by Additional Sessions Judge (FTC), Raipur (C.G.) in Bail Petition No. 902/2015 granting bail to respondent No. 2 Taral Solanki who was arrested on 08/05/2015 in connection with crime No. 83/2015 registered at Police Station Amanaka District Raipur (C.G.) for the offence punishable under Section 376 of Indian Penal Code. 3) At the very outset, learned counsel appearing for the petitioner seeks to withdraw this petition with liberty to file afresh as and when occasion arises.

4) Accordingly, the instant petition is dismissed as withdrawn with the liberty as stated above.
