Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 01/02/2018 (1) Learned counsel appearing for the petitioner would submit that the petitioner has preferred an appeal before the appellate authority against the order of termination dated 31.05.2007 which has not been decided by the appellate authority till date. (2) According to the learned counsel for the respondents, the appeal is pending consideration before the appellate authority on account of delay in the filing of the said appeal and therefore the appeal could not consider.
(3) I have heard learned counsel for the parties and perused the record with utmost circumspection.
(4) Be that as it may, the petitioner is at liberty to file an application for condoning the delay occurred in the filing of the appeal before respondent No.2 within a period of four weeks from today. If such an application is filed by the petitioner before the said authority, in that event the said authority shall consider and decide the same and proceed to decide the matter in accordance with law expeditiously within a period of three months from the date of filing of such application.
(5) With the aforesaid observation, the writ petition stands finally disposed of. No order as to costs.
