The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.51/2020, registered at Police Station Mahila Thana, Durg, District Durg (CG), for offence punishable under Section 498-A/34 of the Indian Penal Code.

Having married with the complainant on 24-2-2019 the applicant was regularly causing mental and physical cruelty to his wife by demanding a flat for Rs.55.00 lacs and assaulting her when she refused to bring that much of amount from her parents. 3.

Learned counsel appearing for the State, per contra, would oppose the bail application.

Considering the nature of allegations and particularly considering the allegation of committing physical assault on the wife, this Court is not inclined to extend the benefit of Section 438 of the Cr.P.C. to the applicant.

Accordingly, the anticipatory bail application is rejected. However, in the event applicant surrenders and moves the regular bail application, the jurisdictional Court shall consider and decide the same on the same day.
