1. The petitioner herein seeks to challenge his nonappointment on the post of Assistant Grade III by respondent No.2.

2. In the recruitment process initiated by respondent No.2/Directorate Public Prosecution, the petitioner applied for the post of Assistant Grade III, but his candidature has been rejected on the ground that he did not have one year diploma in Computer application from recognized University, which has been sought to be questioned by the petitioner in this writ petition.

3. Mr.Pranjal Shukla, learned counsel for the petitioner, would submit that though the petitioner's candidature has been rejected on the ground that he did not have one year

diploma in computer application from recognized University and certificate vide Annexure P-6 where he has passed diploma from the University of Technology and Sciences has not accepted and thereby his candidature has been rejected.

On the other hand, Mr.Sanjay Pathak, learned Panel lawyer for the respondents/State, would submit that they have filed the list of recognized Universities, but the University of Technology and Sciences, which has granted Computer Diploma Certificate to the petitioner vide Annexure P-6 is not recognized University, and therefore, his candidature has rightly not been accepted.

5. I have heard learned counsel appearing for the parties and considered their rival submissions made hereinabove and also went through the records with utmost circumspection.

Admittedly, the petitioner applied for the post of Assistant Grade III pursuant to the applications invited by respondent No.2, but the petitioner's candidature has been rejected on the ground that he did not have one year diploma in computer application from recognized University. The respondents have filed the list of Universities, which are recognized for grant of diploma certificate in which name of University of Technology and Sciences vide Annexure P-6 who has granted certificate in favour of the petitioner is missing. No rejoinder has been filed to demonstrate that the University of Technology and Sciences from whom the petitioner has obtained decree for

diploma in computer application is recognized University, as such, it is quite established that the petitioner did not have the requisite qualification for the post of Assistant Grade III and thus, his candidature has rightly been rejected. I do not find any good ground to entertain this writ petition.

7. Accordingly, the writ petition being devoid of merit is liable to be and is hereby dismissed leaving the parties to bear their own cost(s).
