Justice Vimla Singh Kapoor, Order On Board 02.06.2021 This is the first bail application filed under Section 439 Cr.PC for grant of bail to the accused/applicant who is in prison in connection with crime No. 715/2020 registered at Police station Mahasamund for the offence punishable under Section 20 (B) of the NDPS Act. 2.

According to the case of prosecution, on 24.12.2020 the accused/applicant was nabbed for transporting Ganja in a Mahindra vehicle bearing registration No. OD 26-C/4198. 3.

Having heard counsel for the parties, considered the facts and circumstances of the case and the material collected by the prosecution, and also keeping in mind the quantity of the contraband allegedly found in possession of the accused/applicant which comes to around 9.300 Kg, and also considering the fact that the police had already filed the challan after completing the investigation, this Court is of the opinion that it is a fit case to release him on bail.

Accordingly, the application is allowed. It is directed that on his furnishing a personal bond of Rs. 50,000/- with two local sureties of Rs. 25,000/- each to the satisfaction of the concerned Court, the applicant shall be released on bail. The applicant shall appear before the Court concerned as and when so directed.
