Hon'ble Shri Justice P. Sam Koshy Order on Board 18/02/2019

1. The present review petition has been filed seeking review of the order dated 12/04/2018 passed in WPS No. 2600/2018.

2. The grounds for review raised by the petitioner seems to be the grounds on merits which otherwise is not permissible under the review jurisdiction by this Court.

3. The grounds raised appears to be which otherwise are available in an appeal. The grounds that have been raised by the petitioner, literally amounts to deciding the claim of the petitioner on merits once again.

4. Perusal of the order against which the review has been sought shows that the writ petition was rejected by this Court only on the ground on delay and latches. This Court has not touched the merits of the case.

5. In view of the same this Court is of the opinion that the review petition as such may not lie and the grounds raised in the review petition would not be grounds which are otherwise permissible in reviewing of an order.
