Hon'ble Justice Shri Gautam Chourdiya Order on Board 19/01/2021 1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 18/11/2020 in connection with Crime No. 828/2020 registered at Police Station Civil Lines, District - Bilaspur (C.G.) for the offence punishable under Sections 34(1)(a), 34(2) & 59(a) of the Chhattisgarh Excise Act.

2) At the very outset, learned counsel appearing for the applicant, on instructions seeks to withdraw this application with liberty to file a fresh application as and when occasion arises. 3) Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
