There is application for condonation of delay (IA No.1) in this appeal.

Even if we were inclined to condone the delay in filing application, in our considered view there is no merit in the application because the learned Court below has acquitted Hariom taking into consideration that the basis for prosecution case, the memorandum of Hariom regarding his footwear which could not be proved to be belonging to the accused and that the club was seized from an open place, no case is made out for grant of leave to appeal.

Accordingly, the application for grant of leave to appeal is rejected.
