Both the parties submit that the petitioner is still in possession of the land and award for land acquisition has not been passed. 2.
It is further contended that an affidavit has been filed on behalf of respondent No.5 stating that they do not need land as the alternative arrangement has been made and as such do not want to pursue land acquisition proceeding in respect of the land of the petitioner. 3.
Consequently, in view of such submission that the land is not required for respondent No.5, the instant petition has become infructuous. The consequence will follow in view of such submission. 4.
