This is a reference under Section 17 of the Indian Divorce Act, 1869 for confirmation of the decree for divorce passed by the Learned Third Additional District Judge, Durg whereby he granted decree for divorce in favour of the wife and against the husband on the ground of adultery as well as cruelty.

We have gone through the records of the case and a finding of fact has been arrived at by the District Judge after recording the evidence that the husband is guilty of adultery and cruelty. These are pure findings of fact. Even after the notice in reference was issued to the husband, he has
