1. Proceedings of this matter have been taken up through video conferencing.
2. Learned counsel for the petitioner submits that though petitioner's suspension has been revoked and the departmental inquiry has been dropped but salary for the period of
13.10.2008 to 29.12.2009 has not been paid and this period is also held to be not counted for the regular service and, therefore, he may be allowed to make a representation to the State Government raising his grievances which will be directed to consider and decide within the stipulated time.
3. Learned State counsel submits that if the representation is made, it will be considered and decided in accordance with the law within the stipulated time.
4. Be that as it may, the petitioner is at liberty to make a representation within three weeks from today to the State Government claiming full pay and allowances from 13.10.2008 to 29.12.2009 for counting his suspension period and that will be considered decided by the State Government as per the applicable rules, regulations and in accordance with law within 60 days from the day of receipt of representation by passing a reasoned and speaking order. However, by order dated 13.10.2011 (Annexure- R/1) appeal filed by the petitioner has been held to be not
maintainable. Without being prejudiced by order dated 13.10.2011 petitioner's representation will be considered and decided on its own merit.
5. With the aforesaid observation / direction the instant writ petition stands finally disposed off.
