Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 24/09/2021

1. Learned counsel for the petitioner submits that by interim order dated 24.02.2014 the petitioner is working as Superintendent of Tribal Girls Ashram Kui, District Kabirdham and the impugned order dated 28.01.2014 is liable to be set aside.

2. Learned State counsel opposes the submission made by learned counsel for the petitioner.

3. Since the petitioner is working on the post of Superintendent of Tribal Girls Ashram Kui, District Kabirdham by virtue of interim order dated 24.02.2014, for a fairly long time and petitioner continued at original place of posting by that interim order. Accordingly, the impugned order dated 28.01.2014 is quashed to the extent of the petitioner. However, liberty is granted to the Collector, Kabirdham, to pass a fresh order in accordance with law within a period of four weeks. Till passing of order by the

Collector, Kabirdham, in respect of posting of the petitioner the interim order 24.02.2014 shall remain in force. The petitioner is at liberty to file representation before the concerned Collector.

4. With the aforesaid observation / direction the instant writ petition stands disposed off.
