1. The grievance of the petitioner in the present writ petition is non granting of extraordinary pension to the petitioner on the death of her son who died in a Naxal attack in the course of discharging his duties in the police department.

2. Though initially the claim of the petitioner have been turned down by the authorities, however, subsequent to the filing of the writ petition there is a correspondence issued by the District Superintendent of Police District Rajnandgaon to the Additional Director General of Police (Administration), Raipur, recommending the claim of the petitioner for grant of extraordinary pension.

In view of subsequent development and the recommendations made by the office of the District Superintendent of Police, District Rajnandgaon on 23.01.2021, this court is of the opinion that the writ petition can be disposed of directing the respondents No.1&2 to immediately look into the grievance of the petitioner and an appropriate decision on the recommendation of the claim of the petitioner be taken at the earliest preferably within a period of 90 days from the date of receipt of copy of this order. The authorities shall also ensure that if the petitioner is entitled for extraordinary pension, the same shall also be paid including arrears of entire payment from the date of death of the employee within the stipulated period.
