1. This is first bail application filed u/s 439 of the Code of Criminal Procedure for grant of bail to the applicant in connection with Crime No. 200/2017 registered at Police Station Pandariya, District- Kabirdham (C.G.) for the offence punishable under sections 454, 354, 294, 323, 506 & 34 of IPC and sections 7 & 8 of the Protection of Children from Sexual Offences Act, 2012.

2. As per the prosecution case, a report was made on 22.11.2017 by the complainant that the applicant along with co-accused reached their house, the applicant entered inside the house and thereafter caught hold of the prosecutrix and dragged her which was resisted. In the meanwhile, when the uncle of the prosecutrix came there the applicant entered into altercation and abused him and thereafter the applicant tried to outrage the modesty of the prosecutrix.

3. Learned counsel for the applicant would submit that the

applicant has been falsely implicated in this case. He further submits that charge-sheet has been filed, no further investigation is required and the applicant is in jail since 23.11.2017 therefore, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail.

Considering the facts and circumstances of this case especially the fact that charge-sheet has been filed, no further investigation is required and the applicant is in jail since 23.11.2017 and further considering the nature of allegations leveled against the applicant, I am inclined to allow this bail application.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court for his appearance before the said Court.
