h dd 13-A/97 whereby the rst Appellte Court has affirme the fi a d d jugment and decree dated 03.02.1997 passed by Sixth ivil Juge Class II, Durg in Civil Suit No. 29-A/92. d x After arguing for some time counsel for the appellants seeks permission of this Court to Withdraw the present s econd appeal reserving liberty to approach the competent authority under the provisions of Land Acquisition Act for i claiming compensation in respect of the alleged dispossession of the appellants by the respondents or before any other legal forum.

light of the alleged admission on the part of the respondents in their written statement before the trial Court wherein the management has stated that the right of the appellant in respect of the land in Kh. No. 286 if at all was only to receive compensation by moving appropriate application under Section of the Land Acquisition Act that too if he was aggrieved by the action/of the respondents.

In these said circumstances, counsel for the appellants intends to withdraw the present second appeal to avail the remedy under the provisions of Land Acquisition Act or under any other law if permissible.

In View of the same, the appellants are permitted to withdraw the second appeal.

Accordingly, the instant second appeal is disposed of having been withdrawn with the aforesaid liberty. No order as to cost.
