Shri Suryakant Mishra, Panel Lawyer ------------------------------------------------------------------------------------------------ Hon'ble Shri Justice Inder Singh Uboweja Order on Board 08/09/2015 1) By this appeal under Section 374(2) of the Code of Criminal Procedure, 1973 (for short, 'the Code') the appellant has challenged the legality and propriety of the judgment of conviction and order of sentence dated 09.11.2000 passed by the Additional Sessions Judge, Baikunthpur in Sessions Trial No. 52 of 2000. 2) Perused the report dated 26.05.2014 sent by the Additional Sessions Judge (FTC), Baikunthpur, District - Koria in which it has been mentioned that appellant Chitraj died on 23.12.2011 and in this connection death certificate of the appellant has been produced, which is verified by the State counsel and same is taken on record.
3) In view of the above, the instant appeal becomes abated and the same is dismissed as having become abated.
