1. Shyamlal S/o Peela Babu Sahu, aged about 59 years, R/o Village Pawni, Tahsil Bilaigarh, Civil and Revenue District Raipur, (Now Baloda Bazar, Bhatapara (C.G.) ---- Respondent For Petitioners :
Mr. C. K. Sahu, Advocate.
For Respondent :
Mr. Atanu Ghosh, Advocate.
Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 26/11/18 1.
By the impugned order dated 02.05.2014 (Annexure - P/1), the petitioners' application for taking action against the respondent has been rejected by the trial Court finding no merits on the allegation of tempering with the Courts records.
2.
Learned counsel for the petitioners submits that the impugned order is unsustainable and bad in law and is liable to be set aside. 3.
Per contra, learned counsel for the respondent would support the order impugned.
4.
I have heard learned counsel for the parties and perused the
impugned order with utmost circumspection.
5.
The trial Court has clearly recorded a finding that there is no tempering with the Courts records by the respondent and thereby rejected the application which is purely based on record and as such, I do not find any illegality in the impugned order.
6.
Accordingly, the writ petition stands dismissed with no order as to cost(s).
