1. Mr. Atanu Ghosh, learned counsel submits that since the trial Court has already held that the proposed

legal heirs of deceased respondent No. 3 are not his actual legal heirs, therefore, there is no locus in the appeal and also since none has appeared on behalf of the appellant for prosecuting the appeal, this Court has no other option but to dismiss the petition for want of prosecution.

2. Accordingly, the second appeal stands dismissed for want of prosecution.
