1. This is the Second Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 06.02.2016 in connection with Crime No. 18/16 registered at Police Station Nagarnaar (CG) for the offence punishable under Section 20 (b) of the N.D.P.S. Act.

2. The First Bail Application bearing M.Cr.C. No.4911/2016 was dismissed on 24.08.2016.

3. Learned counsel for the applicant submits that though the entire recovery of cannabis was of 29 K.G. but from the possession of the applicant only 9 K.G. cannabis was recovered and the applicant is facing trial since two years, therefore, the applicant may be released on bail.

4. Per contra, learned State counsel opposes the prayer for grant of bail.

5. Perused the earlier bail rejection order. Considering the fact that the earlier bail was rejected on merits, I do not find any change of circumstances to consider this repeat bail application. Accordingly, the Bail Application is dismissed. However, trial Court is directed to expedite the trial. Sd/- Goutam Bhaduri Judge Ashu
