1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 21.11.2020 in connection with Crime No.570/2020 for offence under Section 307 of I.P.C. registered at Police Station- Khamtarai, Raipur, District- Raipur (C.G.).

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

3) Counsel for the State has no objection to the above prayer.
