Learned counsel for the parties do not dispute the fact that the appellants were allowed to sue as indigent persons before the Court below. Further a report of the State Government is perused, which shows that the appellants do not hold any property in village Murkuta. Under the background of this case, the appellants are allowed to prosecute this appeal as indigent persons as no further enquiry is contemplated by this Court and it was stated that they were allowed to sue as indigent persons.
Registry is directed to register the case as a First Appeal. Shri R.S. Patel is appearing on behalf of respondents No.1 to 4 and the state is also represented.
Issue fresh notice to respondents No.5 & 6 on payment of process fee as per rules.
