By way of the instant second appeal, the appellant has challenged the judgment and decree dated 07.02.2002 passed by Third Additional District Judge, Raipur in Civil Appeal No.1-B/2001, whereby the judgment and decree of the Trial Court in Civil Suit No. 20-B/1999 dated 30.04.2001 passed by Third Civil Judge Class-I, Raipur has been confirmed. 2.

Having considered the contention put forth by the counsel for the appellant and on perusal of the record and the findings given by the two Courts below, this Court is of the opinion, that there is concurrent finding of fact given by the two Court below and that from the submission made by the counsel for the appellant no substantial question of law is made out and the entire findings are purely finding of facts, which cannot be interfered now at the second appellate stage. 3.

Thus, the instant second appeal being devoid of merit, the same is rejected, no order as to costs.
