1. The challenge in the present writ petition was to the order Annexure P/1 dated 01.10.2008, whereby the petitioner's services were transferred from Janpad Panchayat to the Pradhan Mantri Gram Sadak Vikas Adhikaran by way of deputation in the garb of giving it a picture of it being an order of transfer.

2. The petitioner had preferred a writ petition and had obtained an interim order on 31.12.2008 by virtue of the interim order it appears that the petitioner continues to work under the Janpad Panchayat.

3. In view of the fact that the petitioner has enjoyed the interim order for almost a decade, by efflux of time the present writ petition has become infructuous.

4. It is held that the respondents shall not act upon the impugned order of transfer dated 01.10.2008 so far as the petitioner is concerned, reserving the liberty of the respondents to issue appropriate orders in the administrative exigency, if it so demands.

5. The writ petition accordingly stands disposed as having become infructuous.
