---- Petitioner

Versus

1. Sudhlal, S/o Pardeshi Ram Sahu, aged about 52 years, R/o Pandripani, Tahsil Nagri, District Dhamtari (C.G.)

2. Tahsildar, Nagri, District Dhamtari, C.G.

3. The Collector, Dhamtari, District Dhamtari C.G. ---- Respondents For Petitioner :

Mr. Kunal Das, Advocate.

Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 12/02/18 1.

This writ petition has been preferred by the petitioner against the order dated 13.4.2015 (Annexure - P/1) passed by the Collector, Dhamtari. 2.

Upon careful perusal, the order passed by the Collector is clearly appealable before the Appellate Authority under Section 44 of the Chhattisgarh Land Revenue Code, 1959 (for brevity 'Act of 1959') 3.

In view of the above, I am not inclined to entertain this writ petition. However, the petitioner would be at liberty to prefer an appeal before the Appellate Authority in accordance with law under Section 44 of the Act of 1959.

4.

Accordingly, the writ petition deserves to be and is hereby dismissed.

No order as to cost(s).

5.

Certified copy of the impugned order be returned to the counsel for the petitioner on furnishing attested photo copy thereof. Sd/- (Sanjay K. Agrawal) Judge Priyanka
