Even in the second round none appears on behalf of the petitioner, therefore this court is compelled to proceed and decide the case on the basis of submissions made by the counsel for the respondents. 2.

The counsel appearing for the respondents submit that the grievance of the petitioner in the instant case was in respect of recruitment made as Angan Badi Worker of the respondent No.6. He submits that a complaint in this regard was lodged before the Collector so far as the respondent No.4 having wrongly granted appointment to the

respondent No.6. The respondent No.4, later had cancelled the appointment order issued in favour of respondent No.6. 3.

The said order of cancellation of appointment was subjected to challenge in an appeal before the Collector, Korba. The Collector, Korba, thereafter has allowed the appeal of the respondent No.6 in a separate proceedings drawn vide order dated 29.12.2008. This order of the Collector dated 29.12.2008 has till date not been challenged by the petitioner before any competent authority or before the writ court as it ought to have been done.

In the absence of any challenge to the said order of the Collector, the same has attained its finality. The said order of Collector was already brought on record by the respondent No.4 by way of reply which was filed in the year, 2010 itself. In spite of that, the petitioner have not cared to challenge the said order before any competent court of law. 5.

Given the aforesaid facts and circumstances of the case, this court is of the opinion that no strong case is made out by the petitioner. 6.

Accordingly, the writ petition stands dismissed. Sd/- (P. Sam Koshy) Judge inder
