Hon'ble Shri Justice Goutam Bhaduri Order on Board 16.01.2020
1. The petitioner was initially appointed as Shiksha Karmi Grade-III on 04.06.2005. He was absorbed in School Education Department on 18.08.2018. The grievance of the petitioner is that despite the fact that he has rendered 10 years of service, he has not been granted time-pay scale/upgraded pay scale and other arrears which are being payable, therefore, he may be granted the said benefit.
2. A perusal of Annexure P-1 would show that the petitioner has made an application to the D.E.O., District Baloda Bazar-Bhatapara stating that he has rendered more than 14 years of service. According to the Circular of the State if the petitioner has rendered more than 10 years of service and is entitled to certain time pay scale/upgraded pay scale then subject to verification of service, necessary pay scale may be granted to him. Consequently, it is directed that the application of the petitioner Annexure P-1 shall be considered and decided within 60 days from the date of receipt of this order. It is made clear that the concerned authority shall verify the service rendered by the petitioner and if he is entitled as per the Circular of the State then in such a case, necessary upgraded pay scale/time pay-scale along-with arrears be granted to the petitioner accordingly.
3. With the above observation/direction, the writ petition accordingly stands disposed off.
