Shri Kapil Maini, PL Hon'ble Shri Justice Goutam Bhaduri Order On Board 08/01/20

1. Heard.

2. The grievance of the petitioner is that the petitioner has retired on 31.05.2019 and despite the fact that all the required documents were submitted the pensionary benefits and other emoluments were not released.

3. Learned counsel for the petitioner refers to the document Annexure P-6 and would submit that the documents were submitted with respondent No.5 on 11.12.2019 despite that till date the pensionary benefit has not been released.

4. Prima facie perusal of the document Annexure P-6 would show that certain documents were submitted by the petitioner so that the retiral benefits may be released including all the emoluments and the said document appears to have been submitted on 11.12.2019. Since the petitioner has already retired, therefore, I do not find it proper to keep the petition pending instead it is directed that the respondents shall finalize the retial benefit of the petitioner and shall release the amount to which the petitioner is entitled within a period of 45 days from the date of receipt of this order.

5. With the aforesaid observation, the writ petition stands disposed of. Sd/- Goutam Bhaduri Judge Ashu
