Heard.

Learned counsel for the applicant submits that because of the fact there is no communication was made as the earlier counsel breathed his last the correct submission could not be made on 28/08/2019. Subsequently, when the client contacted it came to fore that the petition still survives. In view of the submission as the earlier counsel who was appearing had died, the MCC is allowed.

The order dated 28/08/2019 is recalled.
