This revision has been preferred by the Applicant against order dated 24/11/2018 passed by the Family Court in MJC No. 2/2016, whereby the Family Court while allowing the application submitted under Section 125 Cr.P.C granted monthly maintenance of Rs. 1500/- in favour of the Applicant. Thus, this revision has been filed by the Applicant/Wife for further enhancement of said maintenance amount. 3.
I have heard counsel for the Applicant and perused the record. 4.
Though it was pleaded by the Applicant/Wife that the Respondent is a private doctor, he also owned agricultural land and is earning Rs. 15
lakhs yearly, in her Court statement the Applicant herself admitted the fact that the Respondent has no job and he used to walk here and there for his livelihood. The Respondent also admitted the fact that he owned two acres of land at village Mohka. Apart from this, there is no evidence available on record with regard to any other income of the Respondent/Husband. Looking to the above, the maintenance of Rs. 1500/- as awarded by the Family Court is just and proper. 5.
In view of above aspects, I do not find any merit in this case. The revision is, accordingly, dismissed at motion stage itself. Sd/- (Arvind Singh Chandel) Judge Rahul
