By way of the instant revision, the applicant has challenged the judgment of conviction and sentence dated 21.12.2005 passed by Sessions Judge, Durg, District Durg in Criminal Appeal No. 374/2005, affirming the judgment of conviction and order of sentence dated 27.08.2005 passed by the Judicial Magistrate First Class, Bemetara District Durg in Criminal Case No. 29/2005, convicting the accused/applicant under section 34(2) of the Excise Act and sentencing him to undergo rigorous imprisonment for one year and pay fine of Rs. 25,000/- with default stipulation.
2. The report of Jail Superintendent, Central jail, Durg dated 11.10.2018 also goes to show that after completing the jail sentence imposed on him, the applicant has been released from jail on 19.04.2006.

In view of the fact that the applicant has already completed his jail sentence and has been released from jail in the year 2006, and keeping in mind the decision of the Hon'ble Supreme Court in case of D.S. Lahoriya @ Rajeev Sudan @ Vinay Kr. vs. State of Rajasthan, reported in 2007 AIR SCW 7327, the present revision is dismissed as having become infructuous.
