1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 910/2015, registered at Police Station- Supela, District - Durg(C.G.) for the offence punishable under Sections 420, 120B, 34 of Indian Penal Code (for short 'IPC').
2. Learned counsel for the applicant submits that the applicant has falsely been implicated in this case. In a similar nature of offence registered on the basis of a different complaint, the applicant has been released on bail by the co-ordinate Bench of this Court vide order dated 8.12.2017 passed in MCRC No.6349/2017. In both the cases the transaction complained about is the same, hence, on the ground of parity the applicant is entitled to be released on regular bail in this matter as well.

3. Learned State counsel opposes the bail application and submissions made in this respect.
4. Heard both the parties and perused the case diary.
5. Allegation against this applicant is that he is a Director of M/s Real Goat Farming India Pvt. Ltd. This company enticed various depositors to make deposit in the scheme of the company by promising attractive returns in a short period of time and being allured by said promise, number of depositors have made deposits and in turn deposit certificates were issued to them by the company. However, the said company failed to make payment on maturity of the said certificates which resulted in registration of FIR.
6. Considering the entire material of the case, in particular the fact that in a similar matter this applicant has been granted bail by the co-ordinate Bench of this Court, I am of this view that applicant deserves to be enlarged on regular bail.
7. Accordingly, the first bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
