The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.198/2017 registered in Police Station Gandhinagar, District Surguja (C.G.) for offence punishable under sections 379/34, 467, 468, 471 of IPC.

As per the prosecution case, a report was made by one Jitendra Pandey on 22/06/2017 that Bolero Vehicle bearing no.C.G.15B 6170 was stolen which was parked outside the house. Subsequently, police started investigation and the vehicle was recovered at Haiderganj, District Faizabad and the colour of the vehicle was changed and efforts were made to change the chachis number.

Learned counsel for the applicant submits that the applicant has no idea about the alleged theft, he is only working as mechanic in the repair shop, therefore the allegation which is been attributed is without any evidence and the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail. 5.
Perused the memorandum statement of Gangadhar @ Guddu one
of the accused on the basis of which recovery was made. Prima facie documents would show that the applicant alongwith the other co-accused are involved in inter-state theft of the vehicle and memorandum discloses particulars of the other vehicles also. Considering the same and the nature of allegations, this court is not inclined to release the applicant on bail.
