The dispute in the present Writ Petition is the inaction on the part of Respondents in not deciding the claim of Petitioner for compassionate appointment.

Perusal of record would show that the father of Petitioner, i.e., the deceased employee, was in fact an employee of the Postal Department under the Government of India, working on the post of Post Carrier/Distributor.

The Postal Department is one which is already notified under the Administrative Tribunals Act, 1985 and subsequent to the Department being notified all recruitment related matters pertaining to the Postal Department have to be agitated before the concerned Central Administrative Tribunal. In view of the same, the present Writ Petition at this juncture would not be maintainable on this limited ground alone. 4.

Accordingly, the Writ Petition at this juncture is disposed of reserving the right of Petitioner to approach the concerned Central Administrative Tribunal for ventilating his grievances. 5.
