Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 5-31. As both the above bail applications arise out of the same crime number of same police station, they are being disposed of by this common order.
2. These are first bail applications under Section 439 of the Cr.P.C. preferred by the applicants before this Court and their no bail application is pending before any other court.
3. The applicants have been arrested in connection with Crime No. 182/2018 registered in police station Devendra Nagar, Distt. Raipur (CG) for offence punishable under Section 420, 467/34 of the IPC.
4. Case diary not produced. Counsel for applicant in MCRC No. 515/2019 Mrs. Smita Jha produced copy of the charge sheet for perusal of this Court.
5. Heard on I.A. No. 1 and 2 of MCRC No. 250/2019 and I.A. No. 1/2019 of MCRC No. 515/2019 for taking documents on record.
6. On due consideration, all the three applications are allowed. Documents are taken on record.
7. Prosecution story in brief is that applicants and co-accused B.B. Rao had obtained Rs. 50,000/- from complainant Trivendra Kumar Sahu by deceiving him to provide job in secretariat but they did not do so. They did not return back said amount to the complainant. The also received handsome amount from Sanat Sahu, Komal Sahu, Lekhram Sahu,
Gopichand, Sandeep Nishad, Dhanendra Sahu, Pawan Narayan Sahu, Shesh Narayan Verma, Jagannath Sahu, Manoj Sahu, Sanjay Yadav, Harishankar Sahu, Ghanshyam Sahu, Chiteshwar Sahu, Devendra Nirmalkar, Khileshwar Sahu, Hitesh Sahu, Ved Prakash Sahu and Kamdev Sahu deceiving them to provide job.
8. Counsel for the applicants argued that the applicants are innocent and have been falsely implicated hence they be released on bail.
9. On the other hand, the State Counsel opposed the bail applications. 10.As per arrest memo of applicants Rupendra Kumar Verma and Shalini Verma, which are part of charge sheet, no criminal antecedent is reported against them.
11. As per photocopy of affidavits of Trivendra Sahu, Gopichand, Chetanlal Sahu, Pawan Narayan Sahu, Lekhram Sahu, Ku. Savitri Sahu, Hitesh Sahu, Dhanendra Kumar Sahu, Devendra Nirmalkar, Manoj Sahu, Komal Sahu, Ved Prakash, Sandeep Nishad, Shesh Narayan Verma, Jagannath Sahu, which are part of the bail application of Rupendra Kumar Verma, they have no objection if the applicant Rupendra Kumar Verma is released on bail. 12.As per photocopy of affidavits of Trivendra Sahu, Gopichand, Ghanshyam Sahu, Pawan Narayan Sahu, Chetanlal Sahu, Hitesh Sahu, Ku. Savitri Sahu, Devendra Nirmalkar, Lekhram Sahu, Dhanendra Sahu, Harishankar, Khileshwar, Manoj Sahu, Komal Sahu, Ved Prakash, Sandeep Nishad, Shesh Narayan Verma, Jagannath Sahu, which are part of the bail application of applicant Shalini Verma, they have no objection if the applicant Shalini Verma is released on bail.
13.Looking to the facts and circumstances of the case, as the trial will take its own time, the applications are allowed. It is ordered that if each of the applicants furnishes two solvent sureties each for a sum of Rs. 25,000/- along with one personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned with the condition that they will not involve themselves in any of the crime in future, they be released on bail.
