1. Proceedings of this matter have been taken-up through video conferencing.

2. Mr.Pranjal Shukla, learned counsel for the petitioner, would submit that the petitioner has retired from the post of Lecturer on 31.8.2005, but he has not been given non-practicing allowance and his pension has been determined without giving non-practicing allowance though he has made several representations to the respondents, but same have not been considered and decided by the respondents in accordance with law and thereby his pensionary benefits are being affected and low pension is being provided to him though similarly situated persons have been granted non-practicing

allowance.

3. On the other hand, Mr.Ravi Bhagat, learned Deputy Government Advocate for the respondents/State, would submit that the petitioner's representation will be considered and decided by respondent No.2 within 45 days from its receipt.

4. Be that as it may, the petitioner is at liberty to make a fresh representation along with old representations before respondent No.2 within two weeks from today. If such a representation is made, respondent No.2 shall consider and decide the same on its own merit, in accordance with applicable rules and regulations within 45 days from its receipt and to pass a reasoned and speaking order.

5. With the aforesaid observation / direction, the writ petition finally stands disposed of. NO order as to cost(s).
