This writ petition has been preferred by the petitioner being aggrieved by the order dated 22.09.2017 (Annexure - P/1) passed by the Collector, Raigarh.

Learned counsel appearing for State would submit that the appeal preferred by respondent No. 1 has been allowed by the Collector, Raigarh by order dated 22.09.2017 and, therefore, the remedy available to the petitioner is to file revision under Section 50 of the Land Revenue Code before the Commissioner, as second appeal is barred.

In view of the availability of the alternative remedy to the petitioner,

this Court is not inclined to entertain this writ petition and accordingly, the petitioner is relegated to the remedy of revision before the Commissioner. If such revision is preferred by the petitioner within a period of 15 days from today along with an application for condonation of delay, then the Revisional Authority shall consider and do well to decide the revision preferred by the petitioner expeditiously.

Certified copy of the impugned order be returned to the counsel for the petitioner on furnishing attested photocopy thereof. 5.

With the aforesaid direction, the writ petition stands finally disposed of. No order as to cost(s).
