Heard on admission. Perused the material available. 2.

A criminal case has been filed against the present Petitioner by the Respondent/Complainant before the Judicial Magistrate First Class, Kawardha for an offence punishable under Section 138 of the Negotiable Instruments Act.

Learned Counsel appearing for the Petitioner submits that the Petitioner has taken KGC and TL loans from the Respondent's Bilaspur branch and, therefore, the Court of Judicial Magistrate First Class, Kawardha has no jurisdiction to hear the said criminal case.

Apart from the ground of jurisdiction, no other ground has been raised by the Petitioner for transfer of the criminal case. The ground of jurisdiction to hear the criminal case is arguable before the concerned Judicial Magistrate First Class, Kawardha.

Therefore, I do not find any substance in the instant transfer petition.

Accordingly, the transfer petition is dismissed at the admission stage itself.
