1. Learned counsel for the petitioner submits

that by this petition petitioner has challenged the order dated 20.05.2014 which is unsustainable and band in law.

2. Learned State counsel submits that by virtue of interim order dated 03.07.2014 petitioner has allowed to continue work at Medical and Health Officer, Kabirdham, C.G.

3. I have heard learned counsel for the parties and considered their rival submissions and also perused the record with utmost circumspection.

4. Since the petitioner is working by virtue of interim order dated 03.07.2014, for a fairly long time at present place of posting.

Accordingly, the impugned order dated 20.05.2014 is quashed to the extent of the petitioner. However, liberty is granted to the Chief Medical and Health Officer, Kabirdham to pass a fresh order in accordance with law. Till passing of order by the Chief Medical and Health Officer, Kabirdham, in respect of posting of the petitioner the interim order 03.07.2014

shall remain in force.

5. The instant writ petition is allowed to the extent indicated herein-above.
