It is contended on behalf of the respondents in this petition that the petitioner have challenged the letter of intent issued in favour of the respondent No.4 for allotment of dealership of retail outlet of LPG at Sarangarh. Learned counsel for respondents No.1 to 3 submits that subsequent to this petition allotment letter has been issued in favour of respondent No.4 which is also subject of challenge in WPC No.786/2014 since letter of appointment is already under challenge and this petition is only with respect to the letter of intent, grievance is

already covered which is under challenge in WPC No.786/2014. 2.

Under the facts of this case, this petition has become infructuous.

Accordingly, the petition is dismissed as having become infructuous. Petitioner shall be at liberty to raise all the grounds of challenge in WPC No.786/2014 which is pending. Sd/- (Goutam Bhaduri) JUDGE gouri
