Hon'ble Shri Justice P. Sam Koshy Order on Board 05/02/2020 1.

Though the present writ petition was filed way back in the year 2013 challenging the order dated 6.3.2013 (Annexure P-1) that was an order of promotion granted to the private respondents, today when the present writ petition came up for hearing, learned counsel for the petitioners submits that by efflux of time the petitioners do not intend to challenge the impugned order dated 6.3.2013 any further. 2.

Learned counsel for the petitioners further prays that now that there are a large number of vacancies available in the department and the petitioners fulfilling the requisite eligibility criteria, their purpose would be served if the respondent authorities are directed to consider the case of the petitioners for promotion against the existing vacancies subject to their fulfilling the requisite eligibility criteria. 3.

To the limited prayer that the petitioners have made, learned State Counsel does not have any objection.

4.

Accordingly, the respondent authorities are directed to consider the case of the petitioners for promotion taking into consideration the existing vacancies as on today, subject to the petitioners' seniority and fulfilling the eligibility criteria required for the same. The respondent authorities are expected to take a decision in this regard at the earliest. 5.

The writ petition accordingly stands disposed of. Sd/- (P. Sam Koshy) Judge /sharad/
