1. The limited grievance that the petitioners in the present writ petition have is the non consideration of the claim for promotion from the post of Training Officer to the Post of Training Superintendent.

-22. According to the counsel for the petitioners, all the petitioners have the requisite qualification for the promotion to the post of Training Superintendent and have requisite length of service. There are sufficient number of the posts of Training Superintendent also lying vacant in the department for which the respondents be directed to consider and fill up that posts at the earliest in accordance with law.

3. Shri Abhishek Pandey counsel for the Intervenor as also Ms. Akanksha Jain, Dy. G.A. for the State submit that let the claim of the petitioner be scrutinized by the respondents authorities and an appropriate order be passed in accordance with law and Rules that are governing the field as on date.

4. Given the submission by the Respondents/State, the respondents are directed to consider the claim of the petitioner for promotion in accordance with Rules governing the field as on date and a decision be taken so far as the promotion process for filling up of the vacant posts of Training Superintendent is concerned, in accordance with law at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.

5. It is made clear that this Court has not expressed any opinion on the merits of the case so far as entitlement of the petitioners is concerned. The authorities are expected to take a decision purely in accordance with the Rules and Policies governing the field as on date.
