Hon'ble Shri Justice Chandra Bhushan Bajpai Order on Board 20/08/2015 (1) On 18.6.2015, it was informed by Learned counsel for the Appellant that the Respondent has died. However, he is not in a position to state that when the Respondent has died. Even after grant of time, no appropriate application with regard to the death of Respondent - Smt. Sita Devi has been filed.

(2) In view of above, this Court is left with no other option but to dismiss the instant second appeal as it is abated on account of death of sole Respondent. However, the Appellant is at liberty to file an appropriate petition for setting aside the abatement of instant second appeal with regard to death of sole Respondent. (3) The appeal is dismissed as abated.
