Learned counsel appearing for the State/respondent submitted a communication No.649/15 from office of SHO, P.S. Bilha, District Bilaspur dated 26-05-2015 along with other annexed documents. 2.

As per communication, appellant Lalji Sahu S/o Kunjbihari Sahu had died on 13-04-2006. Copy of the death certificate is also annexed along with the communication and statement of the person who verified death of the appellant.

As per communication, the appellant died on 13-04-2006. No any prayer on behalf of his near relatives filed within stipulated time for continuation of this appeal.

Consequently, the appeal filed on behalf of the appellant stands abated on account of his death under Section 394 (1) of the Cr.P.C. 5.

The appeal dismissed as abated.
