Sam Koshy Order On Board 10.01.2019 The grievance of the petitioner raised in the present writ petition is that the petitioner has by now put in more than 12 years of service as a daily wage worker yet his case for regularization has not been considered by the respondents.

Counsel for the petitioner submits that many of the posts are lying vacant and the petitioner is also discharging his duty against a vacant post.

He further submits that the respondent authorities are required to consider the case of the petitioner for regularization in the light of the circular dated 05.03.2008 of the State Govt.

Counsel appearing for respondent no.2 on advance copy submits that on suitable representation being made by the petitioner, his case shall be considered in accordance with merits taking into consideration the seniority of the petitioner.

Given the nature of dispute raised and the submission made by counsel appearing for respondent no.2, this Court is of the opinion that no fruitful purpose would be served in keeping the petition pending, rather ends of justice would meet if the petitioner is directed to make a fresh representation in addition to any earlier representation that he has made for ventilating his grievance. If such representation is made, the same shall be decided at the earliest preferably within a period of 3 months from the date of receipt of representation of the petitioner. 5.
