ORDER

09.03.2018 Heard.

This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.49 of 2017, registered at Police Station - Narayanpur, District - Jashpur, Chhattisgarh for the offence punishable under Sections 4, 6 and 10 of the Chhattisgarh Krishak Pashu Parirakshan Adhiniyam, 2004.

Learned counsel for the applicant submits that the applicant is in jail since 29.05.2017 and he has been falsely implicated in this case. The coaccused in this case has been granted bail by this Court and the applicant also has a similar case. Hence, it is prayed that the applicant be enlarged on bail.

Learned State counsel opposes the bail application and the submissions made in this respect.

Heard counsel for both the parties and perused the case diary. 5.

According to the prosecution case, the applicant and one of the coaccused person purchased a calf and then slaughtered the same for meat. The police personnel of P.S. Narayanpur made a seizure of meat of dead calf because of which, the offences as aforementioned has been registered against the applicant.

Considering the fact that all the co-accused persons in this case have been granted bail by this Court and the applicant also has a similar case, I am of the considered view that in this case the applicant deserves to be enlarged on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
