1. Learned counsel for the petitioner would submit that by order dated 21/10/2008 (Annexure P/6) petitioner's application for change of post has been rejected on the ground that the said post is not available whereas the post is available, therefore, petitioner may be allowed to make representation which may be directed to be considered.

2. Learned State counsel would submit that if petitioner makes a representation, it will be considered in accordance with law.

3. Heard learned counsel for the parties.

4. Be that as it may, petitioner is allowed to make a representation along with the relevant documents within three weeks from today which will be considered and decided by respondent No. 1 within six weeks from the date of filing of the representation by passing a reasoned and speaking

order. It is made clear that this Court has not expressed any opinion on the merits of the matter.

5. Accordingly, this writ petition stands disposed of. No cost(s).
